Terms of service
Terms of Service
1. About These Terms
These Terms of Service apply to your use of the Vianory Travel Essentials website and to purchases made through our online store.
Please read these Terms carefully before placing an order. By placing an order with us, you agree to be bound by these Terms together with any other policies referred to in them.
Nothing in these Terms affects your statutory rights as a consumer.
2. About Us
Vianory Travel Essentials is a trading name of Richard Wright, a sole trader.
Email: hello@vianory.co.uk
Telephone: 07356 242124
Website: vianory.co.uk
Our business and contact address is provided in our Contact Information and where otherwise required by law.
In these Terms, “Vianory”, “Vianory Travel Essentials”, “we”, “us” and “our” refer to Richard Wright trading as Vianory Travel Essentials.
“You” and “your” refer to the person using our website or purchasing goods from us.
3. Our Online Store
We sell travel-related goods and accessories through our online store.
Some products are stored, processed, packed or dispatched on our behalf by selected suppliers, distributors or fulfilment partners.
Where a third party fulfils an order on our behalf, your contract for goods purchased through our website remains with Vianory Travel Essentials, unless we clearly tell you otherwise before you place the order.
The use of a supplier, distributor, courier or fulfilment partner does not remove or reduce any statutory rights you have against us as the retailer.
4. Product Information
We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate.
Some product information and images may be supplied by manufacturers, distributors or other authorised suppliers.
Product colours and appearance may vary slightly from photographs because of screen settings, photography, manufacturing variations or other reasonable differences.
Measurements, weights, capacities and dimensions may be approximate unless expressly stated otherwise.
For luggage and cabin bags, airline baggage requirements can vary between airlines, routes, fares and aircraft and may change. You are responsible for checking the applicable airline's current baggage requirements before travelling.
A product described as “cabin”, “carry-on”, “flight”, “airline compatible” or similar does not constitute a guarantee that every airline will accept that product as cabin baggage.
If we discover a material error in a product description after you place an order, we will contact you where appropriate and will not knowingly supply a materially different product without your agreement.
Your statutory rights relating to goods that are not as described are not affected.
5. Product Availability
All products are subject to availability.
Stock information may be supplied or synchronised by third-party suppliers and can occasionally change before an order is processed.
Placing an item in your basket does not reserve it.
If a product becomes unavailable after you have placed an order, we will notify you as soon as reasonably possible.
If we cannot supply an ordered product, we may cancel the affected item or order and refund any amount you have paid for it.
We will not substitute a materially different product without your agreement.
6. Prices
Prices displayed on our website are shown in pounds sterling (£) unless stated otherwise.
Prices payable by consumers will include applicable taxes where required.
Delivery charges, where applicable, will be displayed before you complete your purchase.
We may change prices at any time before an order is placed. Changes will not normally affect an order for which a binding contract has already been formed.
We take reasonable care to ensure prices are accurate. If we discover an obvious pricing error, we will contact you before fulfilling the affected order where appropriate.
We will not use a pricing error as a means of changing an agreed price after a binding contract has been formed where doing so would be contrary to applicable law.
7. Placing an Order
When placing an order, you are responsible for checking that the products, quantities, delivery information and other details you provide are correct.
Our checkout process gives you an opportunity to review your order before submitting it.
By completing checkout using a button or function clearly indicating an obligation to pay, you are submitting an order to purchase the goods shown.
After placing an order, you will normally receive an automated order confirmation.
An automated acknowledgement confirms that we have received your order. It does not necessarily mean that the product has been dispatched.
The point at which a binding contract is formed will depend on the checkout and order confirmation information presented to you. Nothing in these Terms permits us to unfairly cancel a binding consumer contract.
8. When We May Be Unable to Accept or Fulfil an Order
There may be circumstances in which we cannot accept or fulfil an order, including where:
- a product is unavailable;
- we cannot obtain authorisation for payment;
- delivery is not available to the address supplied;
- a material product or pricing error has occurred;
- we reasonably suspect fraud or unauthorised payment;
- legal or regulatory restrictions prevent the sale or delivery; or
- information necessary to process the order has not been provided.
Where we cannot fulfil an order after payment has been taken, we will refund sums due for the affected goods in accordance with applicable law.
9. Payment
Payment must be made using one of the payment methods offered at checkout.
Available payment methods may change from time to time.
You confirm that you are authorised to use the payment method supplied.
We may use third-party payment processors to securely process payments. Payment information may therefore be processed in accordance with the relevant provider's terms and privacy arrangements.
We do not impose additional charges without your consent.
10. Delivery
Delivery arrangements, estimated times and applicable charges are explained on our website, at checkout and in our Shipping & Delivery Policy.
Because we use multiple suppliers and fulfilment partners, products may be dispatched from different locations and an order containing multiple products may arrive in separate parcels.
Any delivery timeframe stated as an estimate is an estimate unless we have expressly agreed that delivery by a particular date is essential.
Where applicable, goods will be delivered without undue delay and within the period required by law unless another delivery period has been agreed with you.
Please refer to our Shipping & Delivery Policy for further information.
11. Travel Dates
Many products sold by Vianory Travel Essentials are intended for travel.
If you require a product for a specific holiday, flight, cruise, business trip or other journey, please allow sufficient time for delivery.
Where arrival by a particular date is essential, you should contact us before ordering so that we can establish whether that requirement can be agreed.
An estimated delivery date should not be treated as a guaranteed arrival date unless we expressly agree otherwise.
Nothing in this section limits any statutory rights concerning delivery.
12. Ownership and Risk
Where we arrange delivery, responsibility for the risk of loss or damage to goods will pass in accordance with applicable consumer law.
In general, goods remain at our risk until they come into your physical possession or the physical possession of a person identified by you to receive them, subject to any applicable legal exceptions.
Ownership of goods will normally pass to you once we have received payment in full and the goods have been supplied to you, subject to applicable law.
13. Cancellation and Change-of-Mind Returns
Consumers purchasing online normally have statutory cancellation rights.
For most eligible goods, you have 14 days after receiving the goods to notify us that you wish to cancel, without needing to give a reason.
After notifying us, you will normally have a further 14 days to return the goods.
Exceptions apply to certain goods, including some personalised products and certain sealed goods where applicable.
Our Returns, Cancellations and Refunds Policy explains these rights, return procedures, applicable costs and exceptions in more detail.
Nothing in these Terms limits your statutory cancellation rights.
14. Return Costs
Where you cancel an eligible purchase because you have changed your mind, you will normally be responsible for the direct cost of returning the goods unless we have stated otherwise or applicable law requires us to bear that cost.
Because some products are dispatched by different fulfilment partners, return addresses can vary.
Do not return a product to the sender's address shown on the parcel unless we have instructed you to do so.
Please contact hello@vianory.co.uk before returning an item so that we can provide the appropriate return instructions.
Our Returns, Cancellations and Refunds Policy contains further information.
15. Faulty, Damaged, Incorrect or Misdescribed Goods
Goods supplied by us must meet your statutory rights.
Among other requirements, goods must be of satisfactory quality, fit for purpose where applicable and as described. These rights cannot simply be removed by contractual wording.
If goods are faulty, damaged, incorrect or materially different from their description, please contact us at hello@vianory.co.uk.
Depending on the circumstances, you may have rights to reject the goods, receive a repair or replacement, obtain a price reduction or receive a refund.
These rights are separate from your right to cancel because you have changed your mind.
Please see our Returns, Cancellations and Refunds Policy for further information.
16. Personalised and Made-to-Order Products
Some products may be personalised, customised or made to a customer's specification.
Where the statutory right to cancel does not apply to a clearly personalised or made-to-specification product, this will be made clear where appropriate before purchase.
Please check names, initials, wording, colours, sizes and other personalisation information carefully before submitting an order.
Once production or personalisation has begun, changes may not be possible.
This does not affect your statutory rights where a personalised product is faulty, incorrectly personalised by us or our supplier, damaged, misdescribed or otherwise does not conform to the contract.
17. Manufacturer Warranties
Some products may include a manufacturer's warranty or guarantee.
Any manufacturer's warranty is additional to your statutory rights and does not replace your rights against Vianory Travel Essentials as the retailer.
The scope and duration of manufacturer warranties may vary between products.
18. Promotions and Discount Codes
From time to time, we may offer promotional prices, discount codes or other offers.
Specific conditions may apply and will be communicated with the relevant promotion.
Unless otherwise stated, promotional codes cannot be exchanged for cash.
We may refuse or cancel use of a promotional code where it has expired, has been used contrary to its clearly stated conditions, or where there is reasonable evidence of fraud or misuse.
Nothing in a promotion removes your statutory consumer rights.
19. Gift Cards
If we offer gift cards, additional conditions may apply and will be made available before purchase.
Gift cards do not remove or restrict statutory rights.
20. Third-Party Fulfilment
We may appoint suppliers, distributors, fulfilment providers and delivery companies to perform parts of the order fulfilment process on our behalf.
This may include storing goods, packing orders, dispatching products, processing returns and providing tracking information.
The fact that a third party performs these functions does not by itself make that third party the retailer from whom you purchased the goods.
For purchases made directly from Vianory Travel Essentials, you should contact us regarding problems with your order unless we specifically instruct you otherwise.
21. Third-Party Websites and Links
Our website may contain links to websites operated by third parties.
These links may be provided for information or convenience. Unless expressly stated otherwise, we do not control those websites and are not responsible for their content, availability or privacy practices.
If you purchase goods or services directly from a third-party website rather than through Vianory Travel Essentials, that transaction will normally be governed by the third party's terms.
22. Reviews and User Content
Where our website allows you to submit a review, comment, photograph or other content, you must ensure that your contribution is lawful and does not infringe another person's rights.
Reviews should reflect genuine experiences and must not be fake, misleading or submitted in return for an undisclosed incentive.
We may moderate or remove content where reasonably necessary to comply with law, protect third-party rights or maintain the integrity of our website and review systems.
23. Acceptable Use of Our Website
You must not knowingly:
- use our website for unlawful or fraudulent purposes;
- attempt to interfere with the security or operation of the website;
- introduce malicious software or harmful code;
- attempt unauthorised access to systems or information;
- misuse our checkout, promotions or payment systems; or
- use our content in a way that unlawfully infringes intellectual property rights.
We may take reasonable steps to protect our website, customers and business from misuse.
24. Intellectual Property
Unless otherwise stated, the content and materials on the Vianory Travel Essentials website are owned by us, licensed to us or used with permission.
Product names, trademarks, logos, photographs and other materials belonging to manufacturers, suppliers or other third parties remain the property of their respective owners.
You may use our website for personal, non-commercial shopping purposes.
Nothing in these Terms transfers ownership of intellectual property rights to you.
25. Our Responsibility to You
We do not exclude or limit liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or restricts liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights relating to faulty, unsafe or misdescribed goods.
UK consumer terms cannot be used to avoid responsibility for matters such as faulty goods or goods that are not as described.
We are responsible for losses that are a foreseeable consequence of our breach of contract or failure to use reasonable care and skill, subject to applicable law.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed, except where the law provides otherwise.
Nothing in this section affects remedies available to you under consumer law.
26. Business Use
Our online store is primarily intended for consumers.
If you purchase products wholly or mainly for business purposes, different legal rules may apply.
Unless expressly agreed otherwise in writing, we do not accept liability for business losses such as loss of profits, revenue, business opportunities or anticipated savings to the extent permitted by law.
This section does not affect liability that cannot lawfully be excluded or limited.
27. Events Outside Our Reasonable Control
Events outside our reasonable control may occasionally affect our ability to fulfil an order, such as severe weather, transport disruption, industrial action, widespread system failures or other exceptional events.
If such an event affects an order, we will take reasonable steps to minimise the impact and will communicate with you where appropriate.
This section does not remove any statutory rights you have, including rights relating to delivery, cancellation or refunds.
28. Changes to These Terms
We may update these Terms from time to time, for example to reflect changes in our business, website, fulfilment arrangements or applicable law.
The Terms applicable to an individual purchase will normally be those in effect when the relevant contract is made.
We will not retrospectively change an existing contract in a way that unfairly disadvantages you.
The current version will be published on our website.
29. Complaints
If you are unhappy with a product or with the way an order has been handled, please contact:
Vianory Travel Essentials
Email: hello@vianory.co.uk
Please provide your order number and sufficient information for us to investigate the matter.
We will aim to deal with complaints fairly and within a reasonable time.
30. Governing Law
These Terms and contracts for purchases made through our website are governed by the laws applicable to our business in England and Wales, subject to any mandatory consumer protections that apply to you.
If you are a consumer resident elsewhere in the United Kingdom, you may also be entitled to rely on mandatory rights and bring proceedings in the courts available to you under applicable law.
Nothing in these Terms deprives a consumer of mandatory protections provided by applicable law.
